GGYC looks to court ruling to end America’s Cup delays

New York, 2 April 2008: The Golden Gate Yacht Club (GGYC) said today that it was pleased that the New York State Supreme Court will soon fix the timing for the next America’s Cup match, allowing the whole event to move forward. “It was apparent that Justice Cahn understands that the Deed only provides for the defender to have ten-months notice to prepare for the match,” said Tom Ehman, the San Francisco club’s spokesman. “We were very pleased with the hearing. We continue to look forward to a match in October 2008.”

In July 2007 the American club challenged for a match in July 2008, giving the defender, Société Nautique de Genève (SNG), more than the prescribed tenmonth notice. GGYC has since said that it would race in October 2008, which is ten months from Justice Herman Cahn’s decision last November declaring GGYC the valid challenger. Recent claims by Ernesto Bertarelli, head of SNG’s Team Alinghi, to have been surprised by a 2008 date were at odds with statements he made to the media late last year that Alinghi was getting ready for a match in 2008, Ehman said. During the hearing, the court asked SNG’s lawyer to disclose the location of the match. He declined to do so. In recent days other leading syndicates have called on the defender to stop delaying tactics so the Cup can move forward.

Grant Dalton, Emirates Team New Zealand Managing Director, has called Alinghi’s demands for a 2009 event a “smokescreen.” Vincenzo Onorato, President of the Italian syndicate Mascalzone Latino, said last week: “The best solution now would be to hold the multihull challenge between Oracle and Alinghi, even if, yet again, the latter try to delay the event using every possible tactic.”

“The sooner we race the Deed of Gift match the sooner we can get back to a conventional, multiple challenger America’s Cup,” Ehman said.

Le Juge Cahn rendra une nouvelle décision de justice pour les dates du Deed of Gift Match de l'America's Cup

Lors de l'audience de la Cour Suprême de New York aujourd'hui, le juge Herman Cahn a entendu les arguments de la Société Nautique de Genève (SNG) et du Golden Gate Yacht Club (GGYC) concernant les dates de la 33e America's Cup. La SNG lui demandait de fixer une date leur laissant un délai préalable de 10 mois, comme le veut le Deed of Gift. Le Juge Cahn a indiqué qu'il rendrait une nouvelle décision de justice pour établir les dates du Deed of Gift Match.

Déclaration de Lucien Masmejan, principal avocat de la SNG : "Nous pensons que le Juge Cahn a été réceptif à nos arguments selon lesquels il existe pendant la procédure judiciaire une période d'arrêt qui suspend la préparation pour un America's Cup Match jusqu'à ce qu'une décision de justice soit rendue. Le Deed of Gift stipule que le préavis de 10 mois doit être suspendu pendant la procédure judiciaire. Les seules dates envisageables pour la compétition sont donc ultérieures au 1er mai 2009, en raison des restrictions imposées par le même Deed of Gift pour la saison de régates dans l'hémisphère nord. Il est regrettable qu'aucune date n'ait encore été fixée pour la 33e America's Cup car nous ne sommes pas en position de nous préparer correctement pour notre défense. Le Juge Cahn est d'accord sur le fait que l'America's Cup doit se disputer sur l'eau dans le cadre d'une compétition strictement sportive, et non dans les tribunaux. Nous espérons obtenir rapidement un résultat favorable".
